my betta lays on his side

Okay i notice today that he jus lays on his site, and when i talk to him he move that normal...

the water is 71...

and it seem he still hasnt eatin anythin yet either

The temperature in the tank is still too low, and you should try raising it to 76. Do you have somewhere warmer you could place the tank until such time that you're able to get a heater?

I would also suggest that you carry out an immediate partial water change - if you still have uneaten food in the tank it will be polluting the water. Remember to dechlorinate the water you add, and bring it up to roughly the same temperature as that in the tank. Hope that helps.

At 71F most any betta will be lethargic. If you can get it to between 78 and 80, it will likely be much more active. If not, its time to look for other causes.
