Anyone know anything about tax law?
I've been seperated from my wife for almost two years... She stole my 2007 tax return (about $1000) and legally I could do nothing. (Can't prove I didn't give her permission, plus we were together most of that year) But, I did my Efile (married, filing seperately) and it was rejected because I was listed on her tax return, which she filed as married filing jointly.
She doesn't even have my W-2s, and I have the distinct feeling that she's going to get the money, and I'm going to get arrested for tax fraud.
Go somewhere to file your taxes. Once the IRS sees that your social security number is being used for more then 1 application, they will audit! She will have to show proof to the IRS for everything that she filed for, as will you.
My wife was married before me...she had this type of situation with her ex too. Her divorce lawyer got involved and straightened out the problem.

Do divorce lawyers have to be paid up front ("retainer fee")?
He took care of it as part of representing her for the divorce. There wasn't any additional charge. It was also 30 years ago...go to the tax pro!!!! :lol:
If she included you on a tax return filed as "married, filing joint you have to sign that return. If you didn't and she signed for you it's fraudulent. If she e filed I'm not sure how you prove you weren't part of the filing. There's no way to prove it. I'd consult a tax attorney. With e filing this sort of thing probably happens a lot. But if you don't give your permissions, a signature the old fashion paper way, I'm not sure what happens in that case.
Even a small consultation fee to a lawyer just to screw her over for trying to screw you up is worth it imho.

I have no advice for you though, unfortunately, as I've never jointly filed taxes. Sorry!
