I'm not sure if you could say it was entire based on instinct.
Killer whales are smart animals. I've seen video footage of them dragging seals out to sea just to toss them back and forth with their tails (they weren't even trying to eat the seal). For some reason, I think animals that have that sort of human level of thought processes are more dangerous than those that act purely out of instinct because they're less predictable as a result.
I don't agree with Kym about the "all marine mammals" thing, but I do think it's nuts keeping an animal that lives in groups in the open ocean in a small tank like this. That'd be like keeping a zebra danio in a soup bowl.
