Help on fish ID?

So my mother helps out this family back in my hometown and gets their kids to school on time. She just e-mailed me these photos of a tank in one of the girl's classrooms, asking if I knew what kind of fish they were and if they needed a filter. She said they're in a 3-5 gallon tank.

Now obviously they need a larger tank, which I told her, and I'm assuming that they do indeed need a filter... but I have no idea what they are! I'd love to be able to let her know so maybe I can offer advice on a better tank for them. It's obvious they're too large for that tank.

edit; Now that I look at the second picture, it almost looks like a betta... I hope that it's not. e.e;;;
